National Interest Waiver - NIW

National Interest Waiver

A national interest waiver (NIW) is a discretionary immigration benefit that allows certain foreign nationals to obtain a green card (permanent resident status) in the United States without having to obtain a job offer from a U.S. employer. To qualify for an NIW, you must demonstrate that your work in the United States would be of substantial merit and national importance.

There are two main types of NIWs:

  • EB-2 National Interest Waiver: This type of NIW is available to foreign nationals with advanced degrees or exceptional ability in a particular field.
  • EB-1 Extraordinary Ability National Interest Waiver: This type of NIW is available to foreign nationals who are considered to be outstanding in their field, such as scientists, artists, athletes, and business executives.

To qualify for an NIW, you must meet the following requirements:

  • You must be a foreign national.
  • You must be of good moral character.
  • You must be admissible to the United States.
  • You must demonstrate that your work in the United States would be of substantial merit and national importance.

The application process for an NIW can be complex and time-consuming. It is important to work with an experienced immigration attorney to ensure that you meet all of the requirements and that your application is processed correctly.

Here are the steps involved in the NIW application process:

  1. You must file Form I-140, Immigrant Petition for Alien Worker, with USCIS.
  2. You must provide supporting documentation, such as your CV, publications, and letters of support from experts in your field.
  3. You must pay the application fee.
  4. You must schedule an interview with a USCIS officer.
  5. If your application is approved, you will be granted a green card.

The processing time for an NIW can vary, but it typically takes several months or even years to receive a green card.

If you are interested in obtaining an NIW, you should contact an experienced immigration attorney to discuss your options.
